TERMS OF SERVICE

1. INTRODCUTION

CashPlay (“CashPlay”, “we”, “us” or “our”) provides services to earn money by answering surveys listed and displayed on the CashPlay mobile application (“App”) referred to as the “Services”. By accessing and using the Services, you consent that you have read and agree to be bound by these Terms of Service ("Terms”).

Collection and Use of Your Data

I hereby agree that by using CashPlay may use the following personal data:

1. Installed apps (including the use duration and use history)
2. Registration data (email address, IP address, GAID)

The data is linked to your device via the device ID (GAID or IDFA) ransmitted to our servers in encrypted form. So that app providers can finance our app proposals, your device ID must be transferred to them for billing purposes. In order to measure the usage time as well as the installed apps, users can voluntarily upload screenshots from their mobile phone via the CashPlay, after which they will be automatically processed, evaluated, and stored in our system for your membership.

These Terms constitute a legal agreement between you and CashPlay. These Terms apply globally to all users of our Services on the App and Website. These Terms of use contain terms and conditions that impact your rights, obligations and remedies in connection with the use of the Services of our App and Website. Amongst others, you are obliged to:
- comply with all applicable laws and regulations;
- accept that we have no liability to you;
- accept that you cannot pursue claims or seek relief against us, neither on an individual basis, nor as a participant in any class or representative action or proceeding.

These Terms lead you to accept and comply with all applicable terms when using the Services. Stop using the CashPlay Services immediately, if you do not agree with these Terms. If you fail to comply with the Terms, you may be suspended from using the Services at any point in time. Civil and criminal penalties against you may be enforced.

2. ELIGIBILITY

The Services are only offered to individuals over the age of 18. The App is not a replacement or substitute for your job or any kind of work. You are solely responsible for your actions on and surrounding the App and Website.

3. USER CONDUCT

Users agree not to engage in any activity interfering or disrupting the Services. User may not:
- access, copy, store or use any aspect of the App, Website, or Services as a whole for any purpose other than your own personal use;
- distribute, disclose, publish, sell, rent or otherwise expose any aspect of the Services to any third party;
- prepare derivative access points for our Services;
- circumvent our systems, policies or given suspensions;
- access the Services other than through the currently available, published interfaces that are provided by CashPlay, namely the App and Website;
- mirror or frame any page, feature and functionality of the Services;
- otherwise abuse the Services or breach the Terms;
- attempt to do any of the foregoing, or instruct any third party to do any of the foregoing.

4. UPDATES TO TERMS

CashPlay reserves the right, in its sole discretion, to update the Terms at any point in time and without prior notice. This may include a change, modification, addition, removal or other type of update to the Terms (“Update"). If we choose to update the Terms, we will update the "Last Updated" date at the bottom of the Terms and post the updated version. We do not notify users individually once an Update has been placed.

By continuing to use the Services after we have posted an updated version of the Terms, you agree to be bound by the updated Terms. If the updated Terms are not acceptable for you, please cease using the Services immediately.

5. INTELLECTUAL PROPERTY

Users acknowledge that CashPlay’s Services have been developed, composed and arranged thoroughly with the dedication of substantial time, effort and money. In consequence, the Services of our App and Website display valuable intellectual property and trade secrets of CashPlay.

When a breach in intellectual property arises, CashPlay reserve the right to enforce any intellectual property rights to the fullest extent permitted under law.

Users are encouraged to provide feedback in form of ideas and suggestions for improving the Services ("Feedback”). Feedback may be submitted via email to [email protected]. CashPlay may decide to proactively ask for and select user feedback through the App, Website or via email, too. Users acknowledge that feedback is non- confidential and immediately becomes the sole and exclusive property of CashPlay. Users thereby irrevocably transfer and assign to CashPlay all of their right, title, and interest in and to all Feedback.

6. WARRANTIES, DISCLAIMERS, LIMITATION OF LIABILITY & INDEMNIFICATION

Warranties by Users when using CashPlay: you have the power and authority to acknowledge and agree to these Terms; you own or control all of the rights necessary to provide the information that you provide and to grant the rights and licenses granted herein, amongst others, but not limited to the PayPal account address provided upon requesting a payout; you will neither violate any applicable laws, rules or regulations yourself when using CashPlay, nor cause CashPlay to violate any applicable laws, rules or regulations when using CashPlay or infringe the rights of any third party; you solely provide complete, accurate and up-to-date account information, which is updated as necessary to ensure that it remains complete, accurate and up-to-date.

As Disclaimer, except as expressly provided herein, the Services are provided "as is" and "as available" without warranty of any kind, express or implied.

CashPlay takes no liability or responsibility for the accuracy of the Services in the App or Website or the content of any sites linked to our Services. Claims of the customer for damages are excluded. In line with the Services, users may request a payout to their PayPal account upon completion of one or multiple surveys. The payout threshold may be freely adjusted by CashPlay. After provision of the user’s PayPal account details, CashPlay sends a money transfer to the user’s PayPal account. CashPlay may, in its sole discretion, decide to adjust or cancel the payout request without further reasoning. Likewise, we may decide to terminate the legal agreement and deny further usage of the App or Website for any user, including the deletion of any remaining claims.

To the maximum extent possible by applicable law, you agree to release, indemnify, and hold CashPlay, its affiliates and service providers, as well as their officers, directors, shareholders, agents, employees and representatives, harmless from and against any claims, liabilities, damages, losses, costs and expenses, including tax matters, legal fees and litigation expenses and costs, arising out of or relating to or in any way connected with your use of the Services. You acknowledge that your earnings on CashPlay’s App and Website may be considered reportable and taxable earnings in your jurisdiction.

7. RULES

The rules for a successful credit accrual, respectively a monetary payout through CashPlay, include the adherence of the instruction listed with each individual survey and passing the minimum credit amount. A minimum amount of 4,000 credits is needed to qualify for a payout. The amount of payouts is unlimited. The loyalty program rewards users in strict accordance with the Google Play Developer Program Policy Update, effective March 1, 2021.

8. PRIVACY POLICY

The privacy policy may be adjusted, changed or updated any time. If you do not agree to the privacy policy, please stop using the Services of CashPlay immediately.

9. GOVERNING LAW These Terms shall be governed by the law of the Georgia.
